Terms of Use | Kongato Connects Limited

These Terms of Use ("Terms") govern your access to and use of the Kongato Connects Limited website, job seeker portal and employer portal (together, the "Platform"), operated by Kongato Connects Limited ("Kongato", "we", "us", or "our"). By creating an account, applying for a vacancy, submitting a manpower request, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Eligibility and Accounts

You must provide accurate, current and complete information when registering, and keep your account credentials confidential. You are responsible for all activity that occurs under your account. Kongato offers two distinct account types, job seeker and employer, and you must register for the account type that correctly reflects how you intend to use the Platform.

2. Description of Service

Kongato operates a recruitment and manpower placement platform that allows job seekers to browse vacancies, create a profile, and apply for jobs, and allows employers to submit manpower requests and, once verified, work with our team to source candidates. Kongato staff review manpower requests and control the publication of vacancies to help ensure listings are genuine and accurately described.

3. Job Seeker Terms

You agree to provide truthful and accurate information in your profile, CV and any application. Selection for any vacancy is based on the specific requirements of that role, employer decisions, and eligibility outcomes. Creating an account, completing your profile, or submitting an application does not guarantee an interview, shortlisting, or employment. You are responsible for reviewing the details of any vacancy, including the reference number, employer information and stated requirements, before applying.

4. Employer Terms

As an employer, you agree to provide accurate company and contact information, and accurate details of any manpower request or job requisition you submit, including genuine vacancy requirements. Employer accounts are subject to a verification process, and Kongato may request supporting documentation. Kongato staff retain the right to review, request clarification on, approve, or decline any manpower request or job requisition before a vacancy is published. Employers must not use the Platform to collect candidate information where no genuine vacancy exists.

5. Fees

Where any fee is legally applicable to a service Kongato provides, it will be communicated to you clearly in advance through official channels and receipted. Kongato does not charge undisclosed or hidden fees, and you should never make a payment to any person or account claiming to represent Kongato outside of an officially communicated and receipted process. 6. Prohibited Conduct

You agree not to: provide false or misleading information; impersonate any person or entity, or misrepresent your affiliation with Kongato; post or submit a vacancy that does not reflect a genuine current recruitment requirement; harvest or scrape data from the Platform; attempt to gain unauthorised access to any account or system; upload malicious files or content; or use the Platform for any unlawful purpose, including facilitating fraudulent overseas recruitment.

7. Intellectual Property

The Platform, including its design, text, graphics, logos and underlying software, is owned by or licensed to Kongato Connects Limited and is protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from the Platform without our prior written consent, other than for your personal, non-commercial use of the services as intended.

8. Third-Party Links and Content

The Platform may reference or link to third-party websites, government resources, or services that are not operated by Kongato. We are not responsible for the content, accuracy, or practices of any third-party site, and inclusion of a link does not imply endorsement.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis. Kongato does not guarantee that any job seeker will be selected or placed, that any employer will find suitable candidates, or that the Platform will be uninterrupted or error-free. Vacancy information is provided based on details supplied by employers and, while we take reasonable steps to review listings before publication, Kongato does not independently verify every detail of every vacancy.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Kongato Connects Limited shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Platform, including loss of expected employment, income, or business opportunity. Nothing in these Terms limits any liability that cannot be excluded under Kenyan law.

11. Suspension and Termination

We may suspend or terminate your account if you breach these Terms, provide false information, or engage in conduct that we reasonably believe is fraudulent, abusive, or harmful to other users or to Kongato. You may close your account at any time by contacting us.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. The date at the top of this page shows when it was last updated.
